Halachic adjudication of special importance regarding the historic, most veteran and important religious institution in Petach Tikvah – the Lomza yeshivah – a yeshivah whose students included rabbinic leaders of the generations, led by “Sar HaTorah” Rabbi Chaim Kanievsky and the gaon Rabbi Y. G. Edelstein. Two of the leading rashei yeshivah of the previous generation are signed on the ruling: The gaon Rabbi E. M. M. Shach and the gaon Rabbi Shmuel Rozovsky , in their capacity as dayanim. The rashei yeshivah were called in on this case due to its exceptional importance. There is no other known ensemble nor event at which these personalities sat as dayanim.
The ruling dealt with a building called ‘Beit Hamburger’ that originally belonged to the Petach Tikvah yeshivah led by the gaon Rabbi A. Katz, known more commonly as the Lomza yeshivah. The complainants are also a renowned religious institution, no less important, called ‘Nachalat Reuven’ – a prominent kollel led by Rabbi A. Ozer, which had previously been an integral part of the Petach Tikvah yeshivah, and at some point split off from it. The question with which this ruling deals cuts to the core of the establishment of Torah institutions: The question of ownership of the properties; the obligations of the head of the yeshivahs to their employees and lecturers, and more. Apparently, due to the major precedential and public nature of the issues of ownership of Torah institutions, and so that the verdict would be unquestionably accepted, a special beit din was established led by the rashei yeshivah, despite the fact that they had never served as dayanim.
