Collection of [16] personal letters sent by Sir Moses Montefiore to Michael Henry, one of the leaders of the London community and editor of the Jewish Chronicle; fascinating letters from which can learn much about Moses Montefiore’s public activity and his status among the Jews. There is a lot of reference to the Jewish Chronicle, as the addressee was the editor of the newspaper at that time. Montefiore writes much about the importance of Jewish education. Montefiore writes about charity, both for Jewish education and for the poor of the Land of Israel. Letter no. 14 indicates the extent of Montefiore’s public activity. In the letter from July 30, 1873, Montefiore writes about a lecture he gave on behalf of British Jewry in honor of visiting Persian Shah, Naser al-Din Shah Qajar. In his letter, Montefiore protests the way the events were reported by the Jewish Chronicle, as if the meeting was a personal one rather than an official one on behalf of the Board of Deputies. This letter is especially intriguing, since we know that when the Persian Shah met with Montefiore, among the issues brought up in the meeting was a suggestion that Montefiore buy land in Persia and settle Jews there within an autonomous framework under the Shah’s protection. It is well known that this program was not executed; yet, this letter is an indication of the relationship between Montefiore and the Shah. The letters also demonstrate Montefiore’s sensitivity, since he apologizes for his health not permitting him to attend events or write his letters by himself (Montefiore was in his mid-nineties when the letters were sent). 13 of them are signed in his hand, 1 letter is entirely handwritten by him, and 2 were written by his family member Alice Montefiore (apparently, his niece Alice, granddaughter of Avraham, Montefiore’s brother). Following is a description of the letters: 1) August 9, 1869, hand-signed by him. Written to express appreciation for a letter of condolence he received from him when his sister (Rebekah Solomons) passed away. He apologizes for not being able to write letters by himself anymore. At the end, he invites him to visit him in Ramsgate. 2) February 21, 1870, hand-signed by him. Montefiore writes to invite him with Mr. Samuel next Friday; he did not want to bother him since the place was covered in snow. But given that he has confirmed his visit, he is looking forward to it. He apologizes for his scribe writing the letter for him. With a wax seal of the Montefiore’s coat of arms, a lion holding a “Jerusalem” flag. 3) February 23, 1870, hand-signed by him. Montefiore writes that he is sending him the translation of the precious letter by the gabbaim of the Jerusalem communities to be printed in his newspaper. He apologizes for not being able to travel himself to London to take care of the matter because of his health. He invites him to visit on Sabbath. With a wax seal of Montefiore’s coat of arms, a lion holding a “Jerusalem” flag. 4) March 3, 1870, hand-signed by him. Expressing appreciation for a check for 1.1.0 pounds for the poor of Jerusalem. 5) April 1, 1870, hand-signed by him. Expressing appreciation for a check for 1.8.0 pounds by the “Boroagh Jewish Schools” for the welfare of the poor of Jerusalem and promises to transfer it to them. 6) April 26, 1870, hand-signed by him. Expressing appreciation to the children of the “Stepney Jewish School” for their donation of 1.3.0 pounds for the poor of Jerusalem. Notes the educational importance of charity to the education of Jewish children and blesses them that they enjoy themselves during the trip arranged for them by Mr. Berl Cohen. He adds an apology for publishing the donations the organization had received in the Jewish Chronicle and notes that he will insist on paying its full price. He also apologizes for omitting his name by mistake in the list of donors. In addition, there is an apology handwritten by Montefiore for corresponding by scribe. 7) November 9, 1870, this entire letter was handwritten by him. Montefiore asks him to accompany him on a short trip and bring him a little food. 8) September 26, 1872, hand-signed by him. Apologizes for his inability to attend the opening ceremony of the “Stepney Jewish School” because of the state of his health. Montefiore declares that the issue of religion is close to his heart, especially the matter of children’s education. It would have been a great pleasure for him if he could have attended the event and been there with the Chief Rabbi. He requests that he apologize on his behalf for his absence. Signed from his sick bed. 9) October 10, 5633 (1872), hand-signed by him. Donates 10 pounds to the Sha’arei Mizrach school. Adds several articles from HaMaggid and HaMelitz for him to study. Wishes him an easy fast (for the upcoming Yom Kippur). 10) January 29, 1873, hand-signed by him. Expressing appreciation for his donation and apologizing for his absence from the sermon of Rabbi Marcus Adler (Chief Rabbi of Britain). He adds that he heard from Rabbi Chaim Gedalyah that the sermon was most successful. He updates him by writing that Rabbi Henry Cohen will deliver a sermon in Ramsgate on Sunday and asks him to come on Friday to spend the Sabbath with him.   11) October 4, 1873, hand-signed. Montefiore expresses appreciation for a donation. He notes that Sergeant Simon’s speech is not meant for the wider public due to its problematic content. However, since it also includes some good ideas about the association of Jews, he recommends handing out some 40 or 50 copies he has printed of it. Supplement: protest against the misunderstanding caused by an article in the Jewish Chronicle about his contribution to the education of Jewish children in order to help them study English. The article implied that the donation was for helping them learn French, when in fact this was not true. 12) June 8, 1873, hand-signed. Montefiore thanks him for agreeing to accept the booklet with Sergeant Simon’s speeches and hand them out to his associates. He suggests that he agree to dedicate them to the children whom they are addressed to.  13) April 20, 1873, hand-signed by him. Montefiore apologizes for his absence from the conference of the Board of Deputies of Britain due to his bad health and wishes them luck. Sends regards from Eduard Samuel. 14) July 30, 1873, hand-signed by him. Lengthy letter (4 pages) about a lecture he gave on behalf of the Jews of Britain in honor of the visiting Persian Shah (king), Naser al-Din Shah Qajar. The letter deals with the “Stepney Jewish School.” Michael Henry (1830-1875) was a Jewish-British journalist, serving as the editor of the Jewish Chronicle from 1860 until his passing in 1875. He was a patent agent by profession. He was very active in public issues, and inter alia, was a member of the Board of Deputies of Britain as well as a member of many charities. He was also active in all that was related to Jewish education in the Stepney neighborhood, as indicated by these letters. (The Stepney neighborhood of London was populated by many Jews in the 19th century, most of them poor immigrants.)  [16] letters, bound together with a deluxe binding with a gilt impression on the spine “Sir Moses H. Montefiore.” Fine-very fine overall condition. Fold marks in many of the letters.  Pay Attention! On this lot VAT Should be Added to the Commission For Foreign Residents As Well.

בידע המתאים. לאלו שאינם בקיאים בנושא זה אנו ממליצים לפנות אלינו בימי התערוכה או לפניה ולקבל מאיתנו את המידע הדרוש.

3 . עצם ההשתתפות במכירה הפומבית וקבלת “מספר רכישה” מאיתנו מהווה אישור והסכמה כי ידועים למקבל המספר. התקנות, הנוהל, התנאים

והנהוג בתערוכות ובמכירה פומבית שלנו ובכל בעיה וספק, באם יתעוררו, בשעת המכירה או לאחריה, עקב רכישת פריטים מסוימים, ינהג הרוכש או

הרוכשת וכן הנהלת החברה כעורכי המכירה, לפי הנהוג והמקובל אצלנו.

4 . היות והחברה אינה אלא עורכת התערוכה והמכירה ואינה בעלת הפריטים עצמם לכן מוסכם ומותנה בזאת כי בכל מקרה, לא תהיה אחריות החברה כלפי הרוכשים אלא עד העברת הכספים לידי המוכרים- בעלים ולכן, באם הועבר כבר התשלום שהתקבל מהרוכש ליד הבעלים, אזי אף אם תלונתו או טענתו של הרוכש תהיה מוצלחת, אנו נעשה כל מאמץ והשתדלות להשיב את כספו של הבעלים. אך לא תהיה כל התחיבות מצידנו לכך, וכן לא ננהל הליכים משפטיים לשם החזרת כספים לרוכשים לאחר שהועברו לבעלים. אולם נסכים למתן האישורים המתאימים מצידנו לרוכש כדי שיוכל לנהל הליכים משפטיים נגד הבעלים.

5 . עם קבלת “מספר רכישה” מאיתנו באופן אישי או טלפוני, מסכים ומתחייב הרוכש לא לתבוע באופן אישי או בתביעה משפטית בכל מקרה של נזק או טעות בתיאורי הפריטים את החברה. כל טענה או תביעה לאחר העברת הכספים לבעלים הנה אך ורק כלפי הבעלים.

מחירים והערכות:

ההשתתפות במכירה מתבצעת באחת מהאפשריות הבאות: א. ע”י הופעת הרוכש\ת בעצמו באולם ב. בא כוחו ג. ע”י הצעות טלפוניות או בכתב, המייפות את כוחה של הנהלת החברה לרכוש עבור המזמינים פריטים שונים ד. דרך האינטרנט.

6 . משתתף המופיע כבא כוחו של אדם אחר, מחייב את עצמו ואת שולחו באותה מידה, ויחויב לעמוד בעצמו בתשלומי רכישותיו עבור משלחו ואנו נראה בו כ”רוכש” לכל דבר, ונוכל לפנות אליו או אל שולחו כדי לממן את הרכישה, לפי ראות עינינו.

7 . באם נקבל הזמנה טלפונית או בכתב לפריט מסוים, נשתדל לפעול למען האינטרס של המזמין כאילו היה הוא בעצמו באולם. אולם, אין התחיבות מצידנו להשיג עבורו את הפריט.

8 . אין התחיבות לקבל כל הצעה שהיא לרבות הגבוהה ביותר וזאת אף אם הרוכש או מיופה כוחו נמצא באולם ומשתתף אישית במכירה.

9 . המכירה עצמה מנוהלת בהכרזת דולרים של ארה”ב. אולם התשלום בפועל מתקבל בשקלים לפי חישוב הדולר בשער אשר יוכרז עליו בפתיחת המכירה או ביום התשלום (הגבוה מבינהם), או בדולרים של ארה”ב.

10 . א. על כל תשלומי הרוכשים עד $500,000 לפריט מתווספים 24% עמלה. מעל $501,000 לפריט מתווספים 20%. על כל התשלומים יש תוספת מע”מ על העמלה. תוספות אלו הינם חלק בלתי נפרד מהצעת המחיר המתקבל ע”י מנהל המכירה בשעת המכירה וכל ההתחייבות והמשתמע מהן חלות גם על האחוזים.

ב. תושב חו”ל יהא זכאי לפטור מן המע”מ רק במידה והפריט שרכש ישלח לחו”ל ע”י החברה ללא אחריותה ובכפוף להוצאת רשימון יצוא משרותי המכס. הרוכש ישא בכל העלויות הנילוות.

11 . א. צ’יקים בנקאיים או צ’יקים אישיים מתקבלים בהסתייגות עד לביצוע התשלום בפועל ע”י הבנק.

ב. תשלום במזומן, בצ’קים או בהעברה בנקאית מהארץ הם ללא עמלה. תשלום בצ’קים )מחו”ל( או כרטיסי אשראי )מהארץ( יחויבו בתוספת של 1.5% .

העברה בנקאית מחוץ לארץ תחויב בתוספת של 1.5% מהסכום, מינימום 30$ . תשלום בכרטיסי אשראי מחו”ל יחויב בעמלה של 3% . כל החיובים הנ”ל אינם תלויים בתאריך הגביה וכפופים להיתר עיסקה.

2 1 . ליד כל פריט נמצאת הערכת המומחים שלנו. נא להתייחס אל ההערכה רק כאל הצעה בלבד, אין כל הבטחה שהפריטים לא ימכרו מתחת למחיר הנמוך המופיע בהערכה ואין כל בטחון שהמחיר לא יעלה ואפילו בהרבה על המחיר הגבוה. סעיף זה אינו גורע מהגנתנו העקבית על מחיר המינימום של בעל הפריט, הגנה זו מתבצעת על ידינו בדרכים מקובלות והנראות לנו. לצורך זה נרשם גם מחיר הפתיחה ליד הערכה.

פעמים ואנו מקבלים פריטים אשר הבעלים קבעו להם מחיר פתיחה נמוך ביותר, אנו מצידנו קובעים את ההערכה מבחינה מקצועית, לכן אנו רושמים את מחיר הפתיחה, המבוקש ע”י הבעלים אך רושמים גם את ההערכה שלנו, שהיא לפעמים גבוהה בהרבה ממחיר הפתיחה.

13 . הרוכש (לרבות אדם שרכש את הפריטים שלו שהוא העמיד למכירה) או בא כוחו יוציא את הפריט שנרכש בהקדם האפשרי. אנו מבקשים להופיע תוך 7 ימים, לשלם ולהוציא את הפריטים ומכל מקום בשום אופן לא לאחר יותר מ- 14 יום. כעבור 14 יום החברה תשמור לעצמה את הזכות לגבות 5$ לפריט ליום, דמי שמירה ואחסון ו/או לבטל את המקח בצורה חד צדדית, בלי לוותר על זכות התביעה של העמלות.

14 . משלוח הפריטים אל בית הרוכש, מתבצע על אחריותו הבלעדית, ובדרך שתיראה לנו. כל הוצאות משלוח וכו’ על חשבון הרוכש.

15 . הרוכש ישלם על רכישותיו לפני הוצאת הפריטים ממשרדי החברה.

16 . לידיעת הבעלים: אין אנו אחראים לביצוע בפועל של התשלומים אשר התחייבו הרוכשים לשלם בשעת המכירה. כל התחיבות של הרוכשים אשר לא תבוצע בפועל, ניתן את כל הגיבוי לבעל הפריט ]לשעבר[ לגבות את התשלומים המגיעים לו. אך לא ננהל בפועל הליכים משפטיים כנגד רוכשים,

אלא נשתדל בכל הדרכים הנראות לנו כגון עיקול כספים של רוכשים באם נמצאים אצלנו, או חפצים שלהם וכדומה, אך איננו מתחייבים לעקל כספים וכדומה.

17 . למרות כל האמור מסכימים הרוכשים והמוכרים לראות בנו כצד משפטי לכל דבר במקרה ונעמוד על זכותנו הניתנת לנו בזה, לנהל הליכים משפטיים ולנקוט בכל דרך מקובלת אחרת כנגד צד שאינו עומד באיזהו שהיא מהתחייבויותיו.

18 . אנו משאירים לעצמנו את הזכות להודיע בע”פ או בכתב, עד שעות המכירה, על שינויים בסעיפים דלעיל או הוספת שונות באם יהיו כאלו.

19 . בכל מקרה של שינוי, תוספת או השמטה בתרגום לאנגלית, הנוסח העברי קובע.

A GUIDE TO THE PARTICIPANTS IN THE EXHIBITION AND PUBLIC AUCTION REGULATUON AND PROCEDURES
 Winner’s Auction LTD (the company) – is hereby holding an exhibition in Judaica, to enable the public to examine these
important items, with the possibility of purchasing them at an auction sale to be held at the conclusion of the exhibition. For the convenience
of the public, we have published a detailed catalogue with photographs and descriptions for each item. Catalouge description are based on
the opinions of our experts. However, the sole responsibility of the buyer to inspect each lot. Please regard the catalogue as your personal
guide to the exhibition and auction. Our staff will be at your assistance throughout the exhibition and auction.
Administration of the auction and conditions of Auction:
The auction itself will be directed by an experienced auctioneer according to the standards and regulations of auction houses. We request
visitors and participants to familiarize themselves with the regulations and current conditions. We recommend that people unfamiliar with
these regulations ask our staff at the exhibition for the information they deem necessary.
* Participation in the public auction and receipt of a “participant’s number” are tantamount to the confirming and agreeing that the
recipient of the number is familiar with the regulations, procedures, and conditions of our exhibitions and public sales. Any problems
arising during the auction sale or afterwards as a result of a purchase will be resolved by the purchaser and the management of the company
in according with accepted practice.
* Since the company is merely the organizer and administrator of the exhibition and auction, and is not the owner of the items themselves,
it is hereby agreed and stipulated that in no case will the Company be responsible to the purchasers after the transfer of the payment to the
seller- owners. Thus, in case the payment received from a purchaser has already been transferred to the owner, and even if the complaint
or claim made by the purchaser is justified, and we make every effort to have his money retuned to him by the owner, we shall be under
no obligations to do so, and shall not engage in any legal proceedings after it has been handed over to the owner, though we shall agree
to provide the purchaser with suitable documentations on our part to enable him to engage in such legal proceedings against the owner.
* Upon receipt of the “participant’s number”, in person or via telephone, the potential buyer agrees and obligates himself not to prosecute
us or place a lawsuit against us in the event of damage caused or error in the catalogue description. Any complaints or claim after transfer
of the money to the seller, are only valid against the seller himself.
Prices and Estimates:
Participations in the auction is expressed: (a) by the personal presence of the purchaser in the hall; (b) by the presence of his representative;
(c) by means of written or telephoned bids empowering the management of the company to purchase various items for the person ordering
them (d) Via the Internet.
* The presence of the purchaser’s representative obliges him to make good his purchases, with whatever this entails. The company shall
not agree to obligate his sender or to free the representative of any obligation, even though the representative may fill his sender’s name
explicitly in our forms.
* If we receive a telephone or written order for a certain item, we shall strive to act in the interest of the person giving the order, just as if
he himself was in the hall. We, however, are under no obligation to obtain the item for him.
* We are under no obligation to accept any bid, including the highest bid, even though the purchaser or his representative is personally
present in the hall and participating in the auction.
* The auction itself is administered by announcing numbers in US$, though the actual payment may be made in either Shekalim in
accordance with the average rate of exchange which will be announced at the auction hall or at the day of the payment (The highest) or in USD.
* A 24% commission charge is added to all payment made by purchasers up to $500,000. 20% is added up to $501,000. A Vat ia added only on this comission charges. This percentage is an integral part of the bid accepted by the auctioneer during
the auction, and all obligations, etc, apply also to this percentage
* A foreign resident will be exempt from VAT only if the item purchased is shipped outside of the country by the company without its
guarantee and subject to receipt of an export entry from the custom authorities. The purchaser will cover all related expenses.
* Bank and personal checks are accepted tentatively, until they are honored by the bank.
* Payment by cash, checks or transfers within the country will be accepted without further charge. Foreign checks, credit cards (from
Israel) will be charged an additional 1.5%. bank transfers from foreign countries will be charged an additional 1.5% min. $30. Credit card
payments from foreign countries will be charged an additional 3%.
* Each item is accompanied by an estimate value made by our experts. There is no guarantee that the item will not be sold for a lower
estimate nor that the actual price of the item will not be much higher than the highest estimate value. This paragraph does not detract from
our consistent defense of the minimum price determined by the owner of the item.
Additional information and conditions:
* The purchaser or his representative will claim the purchased item as soon as possible. We request that he appear within seven days to
make the payment and collect the acquisition: under no circumstances is this to take place after 14 days from actual date of auction. After 14 days storage charges may be charged of $5.00 per lot per day. The purchaser himself is solely responsible for the dispatch of items to his home, in any way that he deems fit. The purchaser is responsible for the costs involved in such dispatch. Optional shipping insurance is available.
* The purchased item will not leave the company’s premises until payment is made.
* If payment is not received within 14 days of the auction, Winners reserves the right to cancel the sale unilaterally, without foregoing
their claim for commission.
* ATTENTION OWNERS: The company is not responsible for the actual carrying- out of payments undertaken by the purchasers during
the auction. In the event that obligations by the purchaser are not honored, we shall support the former owner of the item is taking steps
to obtain the payment owing him, but we shall not engage in legal procedures against purchasers. We shall proceed in all ways we find
suitable, but we are under no obligations to do so.
* Purchasers and sellers agree to be considered legal parties in every way in case we exercise the rights we are hereby granted to engage in
legal proceedings, or any other accepted steps against a party who does not honor its obligations.
* The Hebrew text of the catalogue is the correct version, and overrides any addition, omission or change in the English translation
