Extremely important halachic-historic letter from the gaon Rabbi Aryeh Leib Poupko, eldest son and successor of the Chafetz Chaim to the Radin rabbinate and as head of the yeshivah there. Radin, 1935. The letter was sent to “the great Rabbi Zelig Leib” [the gaon Rabbi Zelig Leib Todreses of Jerusalem, a confidante of the Chafetz Chaim’s].
The gaon Rabbi Aryeh Leib writes to Rabbi Zelig Leib about matters that are not simple: One does not always have to rule according to halachah (!), and when an obstacle could be created by this, he must know how to occasionally bend the halachah to fit the spirit of the times. (This letter is referring to an inheritance that halachically may not be transferred to the heir because there is still not sufficient evidence, but this could result in it being confiscated by the government). The gaon Rabbi Aryeh Leib mentions his great father, the author of Chafetz Chaim , several times in this letter from the perspective of ma’aseh Rav : “My father would not transfer nor extract the funds from him until receiving a permit”; “Father was very happy when he received a letter from [your] brother.”
Rabbi Aryeh Leib also mentions the gaon, the author of Even HaAzel in his letter: “Abundant blessings and physical health to the gaon R’ Isser Zalman” as well as the gaon Rabbi Mordechai Sender Kopstein, av beit din of Radin – both of whom ascended to the Land of Israel.
