Sefer Mitzvot Gadol by Rabbi Moshe of Coucy. Venice, [1522], Daniel Bomberg Press, one volume. Third edition. Books printed in the early years of the 16th century have a special status – post-incunabula. 
Special Copy: Thousands of glosses in antiquated rabbinical handwriting from the first third of the 16th century decorate the margins around the printed text. All the glosses are in a legible hand and characteristic of the period. Almost all of the glosses are written in the same hand; only a few were written by others. Many of the glosses have yet to be deciphered. However, the in-depth study done on a significant number of them, clearly leads to the startling conclusion that the copy comes from the beit midrash of Rabbi Shlomo Luria, the Maharshal, av”d and Rosh Yeshivah of Lublin. The Maharshal was one of the greatest poskim, Talmudic commentators, and leaders of 16th-century Ashkenazi Jewry. He was famed for his works and responsa, as well as his glosses on early works. Due to the rarity and importance of the glosses, their origins, content, and writer, a public academic recommendation was published, recommending the transfer of this special copy from private possession to a public library, where it will be preserved in an appropriate manner for future generations and enable in-depth study for Torah and research purposes. 
The Content of the Glosses in the Book: (a) A significant amount of the commentary of Rabbi Isaac Stern (a 15th-century Ashkenazi scholar who died in Regensburg in 1495) on the Semag is copied in the glosses. Rabbi Isaac Stern’s commentary on the Semag was first published in Venice in 1547, however it was printed according to an early manuscript. Machon Yerushalayim’s edition of Semag HaShalem contains the commentary according to the author’s edited manuscript, however it is only on part of the Semag. This manuscript features the elucidation of Rabbi Isaac Stern throughout the book, variant to the text of the Venice edition. This transcription could be extremely significant in understanding the development of the work and the relationship between the various editions; (b) Revisions to the text of the Semag, corrected by the proofreader only a few years after the book was printed; (c) A transcription of the entire Sha’arei Dura written by Rabbi Yitzchak ben Rabbi Meir HaLevi of Dura, according to the 1534 Krakow edition; (d) Transcription of an unknown work, Seder Techinot Shel HaRav Shneur, containing orders of French customs, which has never been printed. 
When were these Glosses Written? Out of the thousands of glosses there are two glosses that contain precise testimony about the date and place of writing. The first: “I copied all of this […] on Sunday 11 Tishrei in the year 5298 [September 26, 1537] here in Lemberg.” Also: “I copied this from the Yoreh Deah of Rabbi Kalman Virmish […] Sunday 11 Tishrei 5298 here in the city of Lemberg.” This clearly states that the glosses were written in 1537. In addition, the location is clear: “Lemberg” is spelled the way that Lemberg – Lvov – was written at the time in Jewish-halachic writing, as the Maharshal himself testified in his Yam Shel Shlomo, paragraph 32: “Lemburg which is known as Lvov.” The other glosses are estimated to be from other years. However, a thorough study of them indicates that they were definitely written between the years 1523 and 1540.
Discoveries Related to the Content of the Glosses: Some of the glosses that were written before the year 1537 are very similar to the wording in Amudei Shlomo, the Maharshal’s glosses on the Semag. Most of the glosses are identical in regards to the text itself and other unique identifying details, such as the use of uniform phrases, identical source references and, in particular, a common style. Without a doubt, the same person wrote both works, or alternatively, one work was copied from the other. The first premise, which is not out of the question, is that the glosses were written by the Maharshal himself. This premise is based on the great similarity between the glosses that appear both in Amudei Shlomo and in this manuscript. 
However, this manuscript also features Italian characteristics, similar to the Ashkenazic writing in the Northern Italian communities. This fact connects the author to the large group of Jews who settled in northern Italy. In addition, these glosses were written in 1523-1530, when the Maharshal was a young Torah scholar. Did he write his comments on the Semag at such an early period?
The first thought tends to attribute the writing to one of the Maharshal’s teachers. However, the limited number of communities where the Maharshal resided in his adult years and the fact that he did not reveal his teachers’ names leads scholar Rabbi Yisrael Peles to suggest that the author of the “joint glosses” is Rabbi Kalonymus Yerushalmi, the Maharshal’s father-in-law, who was originally from Italy and was a disciple of a disciple of Rabbi Yisrael Isserlin, the author of Terumat HaDeshen. The Maharshal mentions his father-in-law in his responsa and his works with tremendous respect and with many honorifics. According to this suggestion, the Maharshal copied the glosses from this manuscript and they were included in his Amudei Shlomo.
It is important to note that the recently published article about the Maharshal’s library gives much attention to the manuscripts in his library. The Maharshal notes several times that he studied from books in manuscript form and did not suffice with studying from the printed editions. In his search for the most precise work, he compared different manuscripts of the same work in order to fully grasp the writer’s intention. A vivid and interesting description of his manner of study was passed down to us by one of his contemporaries, the proofreader Rabbi Shmuel son of Rabbi Yitzchak Pihem, in the introduction to Chochmat Shlomo: “This is the great deed which he did, he did not stop acquiring old books of the Talmud, Rashi and Tosafot on parchment, and according to them and to the rulings of Rabbi Alfas and Maimonides, Semag and Semak and the Ba’al HaTurim, and the author of the Aruch, and responsa of early and later sages, in their wake he trod and proofread, and corrected any errors.” Likewise, the Maharshal also studied the book Ein Yaakov by Rabbi Yaakav ben Shlomo ibn Habib (first printed in his lifetime, Venice 1546) in order to compare the Talmud’s wording and Rashi’s wording: “From Rashi’s words it seems that it is not written in the Mishnah, and in other books it is also not in the Mishnah, and this is proved from the Ein Yaakov” (Chochmat Shlomo, Succah 45b). This was an interesting and unique manner of study at the time.
When studying the list of books, we find that the Maharshal’s library contained the private libraries of several great rabbis from the previous generations. Among them, the library of Rabbi Yaakov Polack, “The great light of Polish scholars; all of the great rabbis of this land are his disciples.” The Maharshal also owned Rabbi Yaakov Polack’s copy of the Semag, with many glosses and important additions. However, it seems that he did not yet own this manuscript when he wrote his Amudei Shlomo on the Semag, because it is mentioned only in his novellae on the Tur and the prayerbook. Accordingly, it seems that the glosses and novellae on the Tur and prayerbook were written later than the work on the Semag (refer to: Rabbi Yehudah Leib Kliers, Aron HaSefarim Shel HaMaharshal, HaMayan, March 2015).
If the “joint glosses” were indeed copied by the Maharshal from the manuscript before us, this aligns with his style of learning and writing of his glosses on the Semag: He payed great attention to the manuscripts related to the Semag, according to the collection of manuscripts in his private library.
This lot includes the report of researcher Rabbi Yisrael Peles. In addition, Rabbi Peles published an extensive overview of the importance of the manuscript and the discovery of the early works it contains in the Moriah Journal, published by Machon Yerushalayim, March 2015.
The volume bears ownership signatures: “Menachem Mendel son of Rabbi Zvi.” The handwriting indicates that he lived in the 17th century. This is possibly Rabbi Menachem Mendel ben Rabbi Zvi Hirsch of Wegrow, author of Tzintzenet Menachem (Berlin, 1719). An additional signature, “Zvi Hirsch son of Rabbi Mendel Shapira,” possibly refers to “The small one Zvi Hirsch Shapira of Krakow” who signed on the decision of the Council of Four Lands in 1676 and is possibly the grandson of Rabbi Natan Neta Shapira, author of Megaleh Amukot.
Whether the glosses were written by him or copied out by him, this is the personal copy owned by the Maharshal, in which he wrote glosses or from which he copied many glosses, which were included in his great work on the Semag. As stated above, from the “joint glosses” of this manuscript and Amudei Shlomo, it is clearly proven that the Maharshal owned the volume before us and it was possibly part of his library.
The rabbis of the generation after the Maharshal describe him as the greatest sage of his generation, even in comparison with the great rabbis of his generation, Rabbi Yosef Karo and and Rema, and so the historian David Ganz writes about him in the chronicle Tzemach David (part one, 1573): “Rabbi Shlomo Luria of Ostroh is the great luminary, the crown of Israel, the wonder of his time, in whose light our people go and from whose water all of the Jewish Diaspora drink. His name is famous throughout the world, and he taught many disciples, and was greater than all of the members of his generation.” His epitaph states: “Here lies the giant of giants, the king of all of the wisdom of teachers, the great luminary who gave light to the Jewish people for all generations.” 
A rare and important bibliographical copy, with early Ashkenazi rabbinic handwriting, of incomparable Torani, research, and historical importance. 
Without a binding. Missing a number of leaves at the beginning. Blemished margins, affecting text. A few tears and stains. The vast majority of the handwriting is clear and legible.

4 . היות והחברה אינה אלא עורכת התערוכה והמכירה ואינה בעלת הפריטים עצמם לכן מוסכם ומותנה בזאת כי בכל מקרה, לא תהיה אחריות החברה כלפי הרוכשים אלא עד העברת הכספים לידי המוכרים- בעלים ולכן, באם הועבר כבר התשלום שהתקבל מהרוכש ליד הבעלים, אזי אף אם תלונתו או טענתו של הרוכש תהיה מוצלחת, אנו נעשה כל מאמץ והשתדלות להשיב את כספו של הבעלים. אך לא תהיה כל התחיבות מצידנו לכך, וכן לא ננהל הליכים משפטיים לשם החזרת כספים לרוכשים לאחר שהועברו לבעלים. אולם נסכים למתן האישורים המתאימים מצידנו לרוכש כדי שיוכל לנהל הליכים משפטיים נגד הבעלים.

5 . עם קבלת “מספר רכישה” מאיתנו באופן אישי או טלפוני, מסכים ומתחייב הרוכש לא לתבוע באופן אישי או בתביעה משפטית בכל מקרה של נזק או טעות בתיאורי הפריטים את החברה. כל טענה או תביעה לאחר העברת הכספים לבעלים הנה אך ורק כלפי הבעלים.

מחירים והערכות:

6 . משתתף המופיע כבא כוחו של אדם אחר, מחייב את עצמו ואת שולחו באותה מידה, ויחויב לעמוד בעצמו בתשלומי רכישותיו עבור משלחו ואנו נראה בו כ”רוכש” לכל דבר, ונוכל לפנות אליו או אל שולחו כדי לממן את הרכישה, לפי ראות עינינו.

7 . באם נקבל הזמנה טלפונית או בכתב לפריט מסוים, נשתדל לפעול למען האינטרס של המזמין כאילו היה הוא בעצמו באולם. אולם, אין התחיבות מצידנו להשיג עבורו את הפריט.

8 . אין התחיבות לקבל כל הצעה שהיא לרבות הגבוהה ביותר וזאת אף אם הרוכש או מיופה כוחו נמצא באולם ומשתתף אישית במכירה.

9 . המכירה עצמה מנוהלת בהכרזת דולרים של ארה”ב. אולם התשלום בפועל מתקבל בשקלים לפי חישוב הדולר בשער אשר יוכרז עליו בפתיחת המכירה או ביום התשלום (הגבוה מבינהם), או בדולרים של ארה”ב.

10 . א. על כל תשלומי הרוכשים עד $500,000 לפריט מתווספים 24% עמלה. מעל $501,000 לפריט מתווספים 20%. על כל התשלומים יש תוספת מע”מ על העמלה. תוספות אלו הינם חלק בלתי נפרד מהצעת המחיר המתקבל ע”י מנהל המכירה בשעת המכירה וכל ההתחייבות והמשתמע מהן חלות גם על האחוזים.

ב. תושב חו”ל יהא זכאי לפטור מן המע”מ רק במידה והפריט שרכש ישלח לחו”ל ע”י החברה ללא אחריותה ובכפוף להוצאת רשימון יצוא משרותי המכס. הרוכש ישא בכל העלויות הנילוות.

11 . א. צ’יקים בנקאיים או צ’יקים אישיים מתקבלים בהסתייגות עד לביצוע התשלום בפועל ע”י הבנק.

ב. תשלום במזומן, בצ’קים או בהעברה בנקאית מהארץ הם ללא עמלה. תשלום בצ’קים )מחו”ל( או כרטיסי אשראי )מהארץ( יחויבו בתוספת של 1.5% .

העברה בנקאית מחוץ לארץ תחויב בתוספת של 1.5% מהסכום, מינימום 30$ . תשלום בכרטיסי אשראי מחו”ל יחויב בעמלה של 3% . כל החיובים הנ”ל אינם תלויים בתאריך הגביה וכפופים להיתר עיסקה.

2 1 . ליד כל פריט נמצאת הערכת המומחים שלנו. נא להתייחס אל ההערכה רק כאל הצעה בלבד, אין כל הבטחה שהפריטים לא ימכרו מתחת למחיר הנמוך המופיע בהערכה ואין כל בטחון שהמחיר לא יעלה ואפילו בהרבה על המחיר הגבוה. סעיף זה אינו גורע מהגנתנו העקבית על מחיר המינימום של בעל הפריט, הגנה זו מתבצעת על ידינו בדרכים מקובלות והנראות לנו. לצורך זה נרשם גם מחיר הפתיחה ליד הערכה.

פעמים ואנו מקבלים פריטים אשר הבעלים קבעו להם מחיר פתיחה נמוך ביותר, אנו מצידנו קובעים את ההערכה מבחינה מקצועית, לכן אנו רושמים את מחיר הפתיחה, המבוקש ע”י הבעלים אך רושמים גם את ההערכה שלנו, שהיא לפעמים גבוהה בהרבה ממחיר הפתיחה.

13 . הרוכש (לרבות אדם שרכש את הפריטים שלו שהוא העמיד למכירה) או בא כוחו יוציא את הפריט שנרכש בהקדם האפשרי. אנו מבקשים להופיע תוך 7 ימים, לשלם ולהוציא את הפריטים ומכל מקום בשום אופן לא לאחר יותר מ- 14 יום. כעבור 14 יום החברה תשמור לעצמה את הזכות לגבות 5$ לפריט ליום, דמי שמירה ואחסון ו/או לבטל את המקח בצורה חד צדדית, בלי לוותר על זכות התביעה של העמלות.

14 . משלוח הפריטים אל בית הרוכש, מתבצע על אחריותו הבלעדית, ובדרך שתיראה לנו. כל הוצאות משלוח וכו’ על חשבון הרוכש.

15 . הרוכש ישלם על רכישותיו לפני הוצאת הפריטים ממשרדי החברה.

16 . לידיעת הבעלים: אין אנו אחראים לביצוע בפועל של התשלומים אשר התחייבו הרוכשים לשלם בשעת המכירה. כל התחיבות של הרוכשים אשר לא תבוצע בפועל, ניתן את כל הגיבוי לבעל הפריט ]לשעבר[ לגבות את התשלומים המגיעים לו. אך לא ננהל בפועל הליכים משפטיים כנגד רוכשים,

אלא נשתדל בכל הדרכים הנראות לנו כגון עיקול כספים של רוכשים באם נמצאים אצלנו, או חפצים שלהם וכדומה, אך איננו מתחייבים לעקל כספים וכדומה.

17 . למרות כל האמור מסכימים הרוכשים והמוכרים לראות בנו כצד משפטי לכל דבר במקרה ונעמוד על זכותנו הניתנת לנו בזה, לנהל הליכים משפטיים ולנקוט בכל דרך מקובלת אחרת כנגד צד שאינו עומד באיזהו שהיא מהתחייבויותיו.

A GUIDE TO THE PARTICIPANTS IN THE EXHIBITION AND PUBLIC AUCTION REGULATUON AND PROCEDURES
 Winner’s Auction LTD (the company) – is hereby holding an exhibition in Judaica, to enable the public to examine these
important items, with the possibility of purchasing them at an auction sale to be held at the conclusion of the exhibition. For the convenience
of the public, we have published a detailed catalogue with photographs and descriptions for each item. Catalouge description are based on
the opinions of our experts. However, the sole responsibility of the buyer to inspect each lot. Please regard the catalogue as your personal
guide to the exhibition and auction. Our staff will be at your assistance throughout the exhibition and auction.
Administration of the auction and conditions of Auction:
The auction itself will be directed by an experienced auctioneer according to the standards and regulations of auction houses. We request
visitors and participants to familiarize themselves with the regulations and current conditions. We recommend that people unfamiliar with
these regulations ask our staff at the exhibition for the information they deem necessary.
* Participation in the public auction and receipt of a “participant’s number” are tantamount to the confirming and agreeing that the
recipient of the number is familiar with the regulations, procedures, and conditions of our exhibitions and public sales. Any problems
arising during the auction sale or afterwards as a result of a purchase will be resolved by the purchaser and the management of the company
in according with accepted practice.
* Since the company is merely the organizer and administrator of the exhibition and auction, and is not the owner of the items themselves,
it is hereby agreed and stipulated that in no case will the Company be responsible to the purchasers after the transfer of the payment to the
seller- owners. Thus, in case the payment received from a purchaser has already been transferred to the owner, and even if the complaint
or claim made by the purchaser is justified, and we make every effort to have his money retuned to him by the owner, we shall be under
no obligations to do so, and shall not engage in any legal proceedings after it has been handed over to the owner, though we shall agree
to provide the purchaser with suitable documentations on our part to enable him to engage in such legal proceedings against the owner.
* Upon receipt of the “participant’s number”, in person or via telephone, the potential buyer agrees and obligates himself not to prosecute
us or place a lawsuit against us in the event of damage caused or error in the catalogue description. Any complaints or claim after transfer
of the money to the seller, are only valid against the seller himself.
Prices and Estimates:
Participations in the auction is expressed: (a) by the personal presence of the purchaser in the hall; (b) by the presence of his representative;
(c) by means of written or telephoned bids empowering the management of the company to purchase various items for the person ordering
them (d) Via the Internet.
* The presence of the purchaser’s representative obliges him to make good his purchases, with whatever this entails. The company shall
not agree to obligate his sender or to free the representative of any obligation, even though the representative may fill his sender’s name
explicitly in our forms.
* If we receive a telephone or written order for a certain item, we shall strive to act in the interest of the person giving the order, just as if
he himself was in the hall. We, however, are under no obligation to obtain the item for him.
* We are under no obligation to accept any bid, including the highest bid, even though the purchaser or his representative is personally
present in the hall and participating in the auction.
* The auction itself is administered by announcing numbers in US$, though the actual payment may be made in either Shekalim in
accordance with the average rate of exchange which will be announced at the auction hall or at the day of the payment (The highest) or in USD.
* A 24% commission charge is added to all payment made by purchasers up to $500,000. 20% is added up to $501,000. A Vat ia added only on this comission charges. This percentage is an integral part of the bid accepted by the auctioneer during
the auction, and all obligations, etc, apply also to this percentage
* A foreign resident will be exempt from VAT only if the item purchased is shipped outside of the country by the company without its
guarantee and subject to receipt of an export entry from the custom authorities. The purchaser will cover all related expenses.
* Bank and personal checks are accepted tentatively, until they are honored by the bank.
* Payment by cash, checks or transfers within the country will be accepted without further charge. Foreign checks, credit cards (from
Israel) will be charged an additional 1.5%. bank transfers from foreign countries will be charged an additional 1.5% min. $30. Credit card
payments from foreign countries will be charged an additional 3%.
* Each item is accompanied by an estimate value made by our experts. There is no guarantee that the item will not be sold for a lower
estimate nor that the actual price of the item will not be much higher than the highest estimate value. This paragraph does not detract from
our consistent defense of the minimum price determined by the owner of the item.
Additional information and conditions:
* The purchaser or his representative will claim the purchased item as soon as possible. We request that he appear within seven days to
make the payment and collect the acquisition: under no circumstances is this to take place after 14 days from actual date of auction. After 14 days storage charges may be charged of $5.00 per lot per day. The purchaser himself is solely responsible for the dispatch of items to his home, in any way that he deems fit. The purchaser is responsible for the costs involved in such dispatch. Optional shipping insurance is available.
* The purchased item will not leave the company’s premises until payment is made.
* If payment is not received within 14 days of the auction, Winners reserves the right to cancel the sale unilaterally, without foregoing
their claim for commission.
