Letter signed and stamped by the Mahari”tz Dushinsky, during the time he served as chief rabbi of Chareidi Jewry in the Land of Israel. In this letter, he determines that all funds from the charity boxes at the Western Wall and at Rachel’s Tomb are to be transferred to the budget of the Talmud Torahs in Jerusalem.
In this letter, written as a court ruling, the Mahari”tz writes, “Given that it is appropriate and proper that the donations our Jewish brethren donate at holy sites will belong to the public, and that maintenance of the Talmud Torahs in the most sacred obligation placed upon the public, I have agreed to establish that the the income from the funds by the Western Wall and Rachel’s Tomb be dedicated … for the benefit of the Talmud Torahs in Jerusalem.” As is known, one beit din cannot overturn the words of another beit din unless it is at a higher level. How much more so, this regulation, which has never been overturned.
The gaon
Rabbi Yosef Tzvi Dushinsky [1868-1949] was one of the most well-known rabbinic leaders of his time. He served in the rabbinate of Galanta and Chust, where he led the yeshivah – one of the largest and most prominent in the Hungarian countries. In 1933, he ascended to the Land of Israel and was immediately given the position of leading the Edah HaChareidit in Jerusalem, and leader of Chareidi Jewry in the Land of Israel.
